Welcome to LuckInTheAir.com. These Terms of Use (“Terms”) govern your access to and use of the LuckInTheAir website, games, features, and related services (collectively, the “Service”).
LuckInTheAir is operated by Longhouse Branding & Marketing, 20226 Fraser Hwy, Langley, BC V3A 4E6, Canada.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not access or use LuckInTheAir.

2. Description of the Service
LuckInTheAir provides a free online social gaming platform where users can discover and play browser-based games.
The Service may include games and other content provided by third-party developers, publishers, or content providers. Such games may be made available through embedded frames, links, or other integrations.
LuckInTheAir may curate, categorize, organize, and present third-party games for users’ convenience. LuckInTheAir does not necessarily develop, publish, own, or control all games or other third-party content made available through the Service.
The Service is intended for entertainment and recreational purposes.
LuckInTheAir is not an online casino and does not provide real-money gambling, wagering, betting, or casino gaming. Unless expressly stated otherwise, the Service does not involve deposits, wagers, or cash prizes.

We reserve the right to investigate suspected violations and to take appropriate action, including restricting or terminating access to the Service.

Third-party games may be embedded in LuckInTheAir or may otherwise be accessible through the Service. These games and other third-party content may be subject to separate terms of use, privacy policies, licenses, and other conditions imposed by their respective providers.
We do not control and are not responsible for:

- the privacy practices or data collection practices of third-party providers;
- advertisements displayed within third-party games;

The inclusion of a third-party game or other content on LuckInTheAir does not necessarily constitute an endorsement, sponsorship, or recommendation by LuckInTheAir or Longhouse Branding & Marketing.

WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME;
- THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
- THE SERVICE WILL BE SECURE OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;
- ANY PARTICULAR GAME WILL REMAIN AVAILABLE;
- THE SERVICE WILL MEET YOUR PARTICULAR REQUIREMENTS;
- THIRD-PARTY GAMES OR CONTENT WILL BE ACCURATE, RELIABLE, SAFE, OR AVAILABLE.
Nothing in these Terms excludes or limits any warranty, right, or protection that cannot lawfully be excluded or limited under applicable law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LONGHOUSE BRANDING & MARKETING, LUCKINTHEAIR, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATING TO:
- YOUR USE OF OR INABILITY TO USE THE SERVICE;
- THIRD-PARTY GAMES OR CONTENT;
- THIRD-PARTY WEBSITES, SERVICES, OR ADVERTISEMENTS;
- ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE;
- ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF INFORMATION TRANSMITTED THROUGH THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED CAD $100.
The limitations in this section do not apply to liability that cannot lawfully be excluded or limited under applicable law.
12. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Longhouse Branding & Marketing, LuckInTheAir, and their respective officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, costs, and reasonable legal expenses arising out of or relating to:
- your violation of these Terms;
- your misuse of the Service;
- your violation of applicable law;
- your violation of the rights of another person or entity.
This section does not require you to indemnify us for our own unlawful conduct or for matters that cannot lawfully be subject to indemnification.
13. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we will post the revised Terms on this page and update the “Last updated” date. Where required by applicable law, we will provide additional notice or obtain any required consent.
Your continued use of the Service after revised Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Nothing in these Terms is intended to exclude, restrict, or limit any rights or protections that apply to you under mandatory applicable law.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and any other policies or terms expressly incorporated by reference, constitute the agreement between you and the operator regarding your use of the Service, except to the extent additional terms apply to a particular third-party game or service.
